ALCOA, TN – A 2021 Notice of Land Use Restrictions filed with the Blount County Register of Deeds has sent a clear warning to potential investors and government agencies: the 162.5-acre parcel known as Tract 3 of the former Alcoa South Plant is a “toxic” asset in more ways than one.
The document, recorded on April 5, 2021, and signed by Mark A. Stiffler, President of Alcoa Business Park LLC, alongside James S. Sanders of the Tennessee Department of Environment and Conservation (TDEC), outlines a century of industrial degradation that may make the property a permanent liability.
This news story is not a thought experiment. The problem is real, imminent and serious. The City of Alcoa and the City of Maryville have already approved and funded the potential purchase. The Blount County Commission will vote on the purchase at their July 16, 2026, meeting. The agenda refers to exactly to the same parcel of land listed five times in the LAND RESTRICTION and the State’s Property records (Parcel 046 068.01.
A Century of Contamination
Located at 302 North Hall Road, the site was the heart of aluminum smelting operations from the early 1900s until 2009. Decades of heavy industrial use have left behind a staggering list of hazardous “findings” that include:
- Polychlorinated biphenyls (PCBs) from old rectifiers and storage areas.
- Free-phase petroleum products found in groundwater samples.
- Subsurface layers of coal tar pitch, alumina, and cyanide.
- Polycyclic aromatic hydrocarbons (PAHs) and volatile organic compounds saturating the soil.
The High Cost of “Productive Use”
For a private investor or a government entity, the path to putting this land into productive use is paved with astronomical expenses. Under the TDEC-approved Soil Management Plan (SMP), any soil disturbance requires a level of oversight that is both costly and legally perilous.
Potential buyers will face immediate and ongoing costs, including:
- Vapor Mitigation Systems: Before a single brick is laid, developers must evaluate the threat of vapor intrusion. If toxic gases are found rising from the soil, the buyer is forced to install expensive sub-slab venting systems or protective membranes.
- Hazardous Waste Disposal: Any soil excavated must be managed and transported as hazardous material, incurring massive disposal fees.
- Groundwater Bans: The groundwater is strictly off-limits. No wells may be drilled for any purpose, meaning all water must be sourced externally at a higher cost.
- Regulatory Penalties: The “Notice” carries the weight of law. Failure to comply with these rigid restrictions is a Class B misdemeanor and can result in civil penalties of up to $10,000 per day.
A Red Flag for Community Leaders
While government agencies may be tempted to purchase the land for public use, the restrictions explicitly warn against it. The document states that the property is strictly non-residential. Any attempt to repurpose the land for a school, daycare, or church requires a grueling demonstration to TDEC that the site will not pose an “unacceptable risk to public health”.
The risk to young children is particularly acute. Using this site for parks, recreation areas, or Boys & Girls Clubs would place the community’s youth in direct proximity to legacy contaminants like PCBs and coal tar pitch. The environmental burden of this land makes it fundamentally unsafe for vulnerable populations, regardless of any surface-level “remediation.”
The Bottom Line: A Bad Investment
For the government, buying this property is a betrayal of public trust, trading community health for a derelict industrial site that requires perpetual monitoring. For the private investor, the math simply does not work. The initial purchase price is just the beginning of a bottomless pit of mitigation costs, and the resale value will remain suppressed by the permanent “Land Use Restrictions” that run with the land in perpetuity.
In the world of real estate, some “deals” are better left alone. The South Plant is not an opportunity; it is a liability that offers little more than high risk, high cost, and a legacy of contamination.
